A bill has been submitted to the State Duma for consideration, limiting the capabilities of photo and video recording systems in punishing drivers. No, the authors of the bill, LDPR deputies Yaroslav Nilov and Dmitry Svishchev, do not doubt the relevance of the penalty prescribed in the Code of Administrative Violations for refusing to use this element of the passive safety system of a car by a “pilot” and passengers of a vehicle. But they insist that establishing a violation using special technical means is illegal because it is biased.

And it’s hard to disagree with the MPs: the capabilities and skills of the cameras are such that they often don’t see the seat belt because of the driver’s clothing color or style, for example. And the traffic cops who hand out fines based on vague photos make no effort at all to find out the true state of affairs.

In the meantime, we recall that in connection with this and a number of other traffic offenses recorded by cameras, the presumption of innocence does not apply. That is, the driver will be blamed a priori if he was photographed by a special technical aid that works in automatic mode. And if it appeared to the camera that you were not wearing your seat belt, be so kind as to pay 1000 rubles or argue the case in court, which is both a long and gloomy, and, as a rule, meaningless.

That is why the deputies propose that in the explanatory notes to art. 1.5 of the Code of Administrative Violations of the Russian Federation “Presumption of innocence” those violations of the rules that can be detected by special technical means. The list is exhaustive – speeding; exit to the opposite direction; non-compliance with the requirements of signs and markings; violation of the rules for moving heavy and large vehicles; non-payment of “Plato” and toll roads. In other words, cameras “for the belt” or “for the cell phone”, according to the deputies, should not punish car owners because, again, they are all too often mistaken. Only traffic cops can and should catch offenders.

But, alas, the Duma will destroy this bill in all respects: on Okhotny Ryad, they only know how to tighten the screws, ignoring practice and common sense. Well, money, even obtained by unjust means, is needed by the treasury, especially now…
