The Federation Council at its plenary meeting on Wednesday approved an amendment to the Code of Administrative Offenses that introduces a new “punishment-free threshold”. In this case, we are talking about the first part of Article 12.21 of the Code of Administrative Offenses. Now, for exceeding the permissible load on the axle of a truck (popularly – “overweight”) by the amount of not more than 10% of the permissible load, it threatens the driver and owner of the vehicle with serious fines . The driver “shines” a fine of 1000-1500 rubles, and the owner of the vehicle – up to 150,000 rubles. The fine can only be avoided by issuing a special permit in advance for the transport of heavy loads.
The amendment approved by the senators actually cancels the aforementioned part of Article 12.21 of the Code of Administrative Offenses. For example, a “non-penalized overweight threshold” is introduced and an overload of the machine by less than 10% goes unpunished. Carriers can do nothing but satisfy that.
At the same time, the senators supported the transfer of the authority to consider the “administrative” for large transport from the jurisdiction of the Ministry of the Interior to Rostransnadzor. This also applies to cases registered with automatic fixation devices and other special means.
