Another “Yarovaya package” was passed by the State Duma in first reading. This time it concerns heavier penalties for violators of traffic rules and consists of changes to both the Code of Administrative Offenses and the Criminal Code. The new penalties, drafted by a group of deputies from the State Duma, “screw the screws” especially for repeat offenders and driving without a “driver’s license”. In short, first of all, the Code of Administrative Offenses should introduce a penalty for repeated driving within a year without a driver’s license. For this, he is fined 50-100,000 rubles or mandatory work in the amount of 150-200 hours.

And if a citizen deprived of “rights” is caught driving a car for the third time in a year, he will be criminally prosecuted, in connection with the prospect of a fine of up to 200,000 rubles and compulsory work – up to 360 hours.

art. 264.3 – “The driving of a vehicle by a person who has been deprived of the right to drive and is subject to administrative penalties or has a criminal record.” According to it, there will be a chance to really “sit down” for up to a year. But another story will be the most revolutionary for the Russian “automotive” criminal law: for the first time it will be possible to lose a car for breaking traffic rules.

The drafters of the bill propose that art. 104.1 of the Criminal Code, which refers to the seizure of the suspect’s property and valuables, a clause allowing the confiscation of the car belonging to the traffic violator, on which he was in fact involved in his illegal activities. The amendment discusses the possibility of taking cars from citizens involved in criminal proceedings for an accident with victims and deaths. And also under the new article – the aforementioned 264.3. For example, a person who has been deprived of “rights” to enter an oncoming lane, drink-driving or speeding will also be deprived of a car if he is in the legal field of a new criminal article.

Note that over the years a rather characteristic picture has emerged of the introduction of penalties for drunk drivers and reckless drivers. If anyone doesn’t remember, lawmakers and officials started an uncompromising fight against them in Russia more than 10 years ago. They introduced “permille”, deprivation of “rights”, then all kinds of public works, then criminal sanctions appeared and now the confiscation of offenders’ cars is also being prepared. What is characteristic: every time this kind of legislation goes on a cartel track.

That is, for starters, the authors of the legal novella vociferously declare that the current legislation is ineffective, does not deter and does not stop violators, and therefore it needs to be tightened up. Tighten. Another year goes by and again there is a statement that “legislation doesn’t work” and that it needs to be made stricter. Then the cycle repeats. In addition, it is characteristic that the personalities of the initiators of legislative changes, who rant again and again about the need to give the offender even more nightmares, do not change. Like, for example, the honored author of most of the “anti-alcohol” sentences for drivers in the Code of Administrative Violations, Deputy Irina Yarovaya.

Now, together with a group of colleagues in the Duma, she has developed another criminal law on the seizure of cars. After a few years it will become clear again that “legislation does not work”. So, what’s next? What are the next cruel but practically useless laws for drivers that Ms. Yarovaya “and her comrades” are planning to come up with? It’s unlikely anyone can answer this question right now. But it is already clear that the Duma deputies will always have something to do, raising the bar for penalties for insulting drivers to life imprisonment – responsibility can be tightened, tightened and tightened for quite a long time.. .
