The authorities decided to clarify the procedural conditions for holding drivers accountable for traffic violations. The amendment, as the AvtoVzglyad portal found out, has already been submitted to the State Duma for consideration.
Officials propose to consider the period within which the director can be held administratively liable not in months, but in days. Now art. 4.5 of the Code of Administrative Violations speaks of a limitation period of 2 months (from the date of the violation) in the handling of an administrative case by a traffic police officer and of 3 months in a trial. But the fact is that in calendar months there are different number of days: 30 and 31. And in February there are 28 or 29.
That is why the cabinet amendment proposes to consider the statute of limitations not in the form of 2 and 3 months, but in the form of 60 and 90 days. The draft law also stipulates that when the end of the liability period falls on a calendar day off, the first working day following this is considered to be the actual day of the end of this period.
