How the traffic police deprive drivers of their “rights” due to a burnt-out auxiliary brake light

0
Very often you see a car on the road, where not all brake lights are on when braking. For example, if an additional lamp “failed”. And few drivers pay attention to this: after all, the rest of the “stoppers” regularly work notifying others about a decrease in the speed of the car. However, such a really minor malfunction can become fatal at some point – from the point of view of depriving the owner of the car of the “rights”.

Problems due to a “surrendered” lantern arise because the Technical Regulations of the Customs Union require all standard vehicle lighting devices to be usable and operable while driving. An auxiliary brake light is also a regular electrical device of the car. And according to the letter of the law, you can only drive a vehicle if it is in order. If not, put the iron horse on a joke until you fix it.

Traffic police officers are well aware of this subtlety. Usually they do not pay attention to the “stopar” of a car that has stopped to check documents. But from time to time they have all kinds of thematic “raids” or “months”, during which they purposefully “track” all sorts of problems with the technical condition of the machines. And a blown bulb in an auxiliary brake light can be very inconvenient at such a time.

The employee who noticed her will draw up a protocol of 500 rubles under Article 12.5 of the Code of Administrative Offenses for driving a car “in the presence of malfunctions or conditions under which driving vehicles is prohibited.” Although some inspectors in such cases for some reason impose a fine of the same amount under 12.20 of the Code of Administrative Offenses – “Violation of the Rules for the Use of External Lighting Devices”.

But this is not important, because at the same time a request is made to fix the malfunction. And this in this case is the main “ambush”. If you don’t have a spare bulb with you or don’t have the skills to replace it, you won’t be able to continue driving the car. The mechanic will inform the driver to call a tow truck, and then present the repaired vehicle to the shining eyes of the employees of the local traffic police within 10 days.

If you do not comply with this order in time, you will receive a suspension of the registration of your car. After that, you will continue to ride on it, and the traffic police patrol will stop you again – we will talk about article 12.1 of the Code of Administrative Offenses. She talks about “driving a vehicle that is not properly registered.” For the first time, it provides for a fine of 800 rubles, and in case of repeated “hit” – deprivation of the driver’s “rights” for up to three months.

It should be noted that police officers in the Russian regions, after repeatedly stopping a car with a faulty brake light, sometimes immediately “enter with trump cards”: they issue a driver under Article 19.3 of the Code of Administrative Offenses for disobedience to a legal order from a police officer. According to it, you can “ram” 15 days of administrative detention.

So the light bulbs in the “plugs” need to be replaced in time. To avoid the tangle of problems with the traffic police described above.
