If you think that your “rights” are enough for a traffic cop to check the driver’s documents, you are seriously mistaken. The Supreme Court of the Russian Federation has recently confirmed that in addition to VU, every driver is required to carry a passport. Or a military ID – who has it. This point of view is contained in the following overview of legal practice, which was recently published by the Supreme Court. It included the analysis of a lawsuit over a fine for a heavy truck driver who transported oil in a tanker trailer.

He was stopped by a traffic policeman and the driver showed the policeman his “rights” and a certificate (also with photo) of a qualification that allows him to transport dangerous goods. The employee did not have a passport with him. And the inspector of the traffic police fined him for not having an identity card when transporting dangerous goods. The lower courts disagreed with this interpretation of the law and overturned the road agent’s decision.

However, police representatives reached the SC and challenged their position. And the Supreme Court sided with the Interior Ministry! He motivated his decision by the fact that “according to the classifier of types of identity documents in the Russian Federation, a driver’s license is not included in the list of identity documents.”

Indeed, on the website of public services, in this list, in addition to a general passport, only a foreign passport, a child’s birth certificate, a temporary identity card for the time of issuing a passport, a military ID for reserve military personnel, a soldier’s identity card and a sailor’s passport appear. And the driver’s license, which is issued by the Ministry of the Interior, is not on this list.

This means that any traffic policeman on the road, if desired, when checking the documents of a “mate”, in addition to his “rights”, can also demand from him a civilian passport. And then you never know what kind of “filkins brief” he slips for verification under the guise of a VU!

Because it cannot officially serve as an identity card, you should definitely also have a passport with you! Such a precaution is necessary to deprive a traffic cop who has fallen into an administrative and law enforcement rage of the opportunity to tow a driver he dislikes to the nearest police station – supposedly to establish his identity.
