The lawsuit was filed in federal court in San Francisco, California on June 28, 2023. statement of claim states that OpenAI secretly ‘stolen 300 billion words from the Internet’, while not registering as a data broker and not getting anyone’s approval. In turn, Microsoft is a key customer and corporate partner of OpenAI, licensing billions of dollars to the company’s AI technologies.

The lawsuit compares OpenAI’s activities with Clearview AI, another AI company that has previously made headlines for collecting information about people from the internet without their explicit consent.
The lawsuit names several artificial intelligence tools developed by OpenAI and used by Microsoft, including the GPT 3.5 and 4.0 language models, the Dall-E neural network, and the Vall-E text-to-speech model.
Anonymous lists its various online activities over the years, saying they don’t allow third parties to use their personal information to train AI, and that companies “steal personal data from a wide variety of online apps and platforms to train their products.” Data allegedly stolen includes names, contact details, email addresses, payment information, social media information, chat logs, telemetry, analytics and cookies.
The defendants have unfairly enriched themselves by stealing personal information, as billion-dollar AI businesses, including ChatGPT, are built around collecting and monetizing Internet users’ personal data. Thus, plaintiffs are entitled to compensation and/or compensation for their share of the value of the stolen data and/or the profits earned by the defendants, – says the lawsuit.
Therefore, the court is asked:
Ban OpenAI and Microsoft from breaching privacy.
Disclose information about what data is collected and how it is used.
