This Friday, Texas suffered a legal setback in its battle to buoys installed in the Rio Grande, on the southern border of the United States, when a panel of judges upheld a federal judge’s order to remove the 300-meter barrier.

Three-judge panel of the Fifth U.S. Circuit of Appeals rejected Texas’ request to overturn Judge David Ezra’s rulingissued Sept. 6, directing the state to remove some of the buoys installed last July.

The decision represents a victory for President Joe Biden’s government, which sued Texas over install buoys in the Eagle Pass sector as part of Operation Lone StarRepublican Governor Greg Abbott has spoken out against illegal immigration.

The US Department of Justice lawsuit argued that the barrier constitutes “obstruction of navigability” Rio Grande.

For its part, the Texas government protected the installation of buoys claiming he was forced to take action on his own to “protect” himself from the migrant “invasion,” blaming the Democratic federal administration for failing to secure the southern border.

On appeal, Texas argued that Judge Ezra erred in his finding that the buoys constituted an obstruction to navigation on the river and that abused his powers by ordering the removal of buoysarguments with which the commission did not agree.

Texas still has several legal options to pursue the case and even take the case to the U.S. Supreme Court.

The buoys caused the Mexican government to ask the US several times to remove the barrier. claiming that most of the buoys were in Mexican territory..

The International Boundary and Water Commission, a bilateral organization, confirmed this claim in a report submitted to the Ezra Tribunal, which stated that concludes that the vast majority of buoys are on the Mexican side.. (EFE)
