The US Supreme Court accepted the case for consideration ouster of former President Donald Trump GOP Republican Primary in Colorado.

The decision puts the Court in a position to determine the national position on if Trump can participate in the 2024 presidential elections.

Or, conversely, the role he played in the storming of the Capitol in 2021,or renders him unfit.

Public hearings on February 8.

In a brief, the Supreme Court said it has accepted the case and that nine justices will hold a public hearing on Feb. 8 to hear the parties’ arguments.

The request for the high court to hear the case came from Trump’s legal team, which appealed an earlier decision by the Colorado Supreme Court.

Colorado and Maine kicked Trump off the ballot

On December 19 last year, the Supreme Court issued a ruling unprecedented in US history. Colorado kicked Trump out of the Republican primary for his role in the attack on the Capitol.

Later, December 28, Maine became the second state to disqualify Trump.

In this case, the decision was made by the body responsible for organizing elections in this constituency, i.e. Maine Secretary of State, Democrat Shanna Bellows.

Trump’s legal team also appealed the Maine Secretary of State’s decision, in this case to that state’s Supreme Court.

Trump participated in the attempted “insurrection”

In both cases, authorities determined that Trump was involved in an attempted “insurrection,” which disqualifies him from holding public office under Article Three of the 14th Amendment to the Constitution.

This amendment was approved in 1868, after the American Civil War, to prevent the rise to power of Southern Confederate rebels who had sworn allegiance to the Constitution and then betrayed it.

These decisions, absent a U.S. Supreme Court ruling, affect only Colorado and Maine because in the U.S. federal system, each state, not the nation, is responsible for administering elections.

Oregon, Virginia, New York… analyze whether Trump can run

Fifteen other states, including Oregon, Virginia, New York and Nevada, are also deciding whether Trump can run for president.

In the complex American political and electoral system, where states are responsible for organizing elections, even presidential ones, each has its own laws and rules, so the same demands can have different results.

This is where the Supreme Court becomes more important as the decision of the High Court must be respected throughout the country.

Conservative Majority on the Supreme Court

Six of the nine members of the high court are considered conservative, three of them appointed by Trump himself during his presidency, so it would be surprising if they disagreed with the former president.

However, the fact that some of them are followers of “originalism,” a legal movement that advocates interpreting the Constitution as the Founders wrote it, casts doubt on their future decision.

Although a public hearing to examine the case will be held on February 8, it is not yet known when the US Supreme Court will issue its decision and it is unknown how far it will go.

Primary elections in Colorado and Maine are scheduled for March 5. (EFE)
