The National Council for Strategic Litigation (CNLE) cited the views of the Nineteenth Collegiate Administrative Tribunal, located in Mexico City, regarding request for protection which he presented together with the opinion leader Denise Dresser.

The legal appeal was directed against various references at morning conferences and in section “who is who of lies” for stigmatizing comments that were unfounded and violated their right to freedom of expression and dignity, according to a statement from CNLE.

For its part, the Collegial Court published a ruling on the appeal, in which recognized that officials must reasonably and diligently verify information before publishing it in official places.especially in programs financed by public resources, such as the “mañaneras”. In this way, the CNLE has succeeded in setting a standard for the authorities’ actions in relation to the protection of freedom of expression.

Similarly, the Collegial Court considered that the authorities, in fulfilling their duty to inform the public and having the right to freedom of expression, must confirm information in a reasonable manner; provide the public with elements demonstrating the veracity of the information, so as not to present the public with a manipulated version; that the exercise of freedom of expression does not violate the human rights of others.

Just like that the information disseminated is free of any interference of subjective judgments or assessments; They must ensure that their statements do not constitute arbitrary interference with the rights of journalists and, finally, that their statements do not infringe the independence and autonomy of the judiciary.

Although the ruling specifically addressed the “Who’s Who of Lies” section set by the network director, the parameter set by the court applies to any government employee. In addition, The resolution sets the parameter for recognizing the rights of journalists compared to what is specified in publicly funded programmes and recognition of the possibility of exercising the right of reply in these programmes.

This precedent shows that freedom of expression of public officials is not absolute and its limit lies in the exercise and enjoyment of the human rights of citizens, the CNLE states.
