In a court document in support of the Joe Biden government’s appeal, lawmakers asked the Fifth Circuit Court of Appeals in New Orleans, Louisiana, to reverse the lower court judge’s decision.

The group, which includes 50 senators and 190 members of the House of Representatives, said the Texas District Court’s decision “has no legal basis.”

Among the legislators who signed the text are the chairmen of the Committee on Foreign Relations and the Judiciary Committee of the Senate, Bob Menendez and Dick Durbin and former presidential candidate Bernie Sanders.

The document also stressed that the decision by Texas federal judge Matthew Kachsmarik would “significantly reduce access to abortion” in the country, “aggravating an already deep reproductive health crisis.”

The implications of last Friday’s order “could go far beyond mifepristone as it undermines the evidence-based, expert-led process that Congress has developed to determine whether the drug is safe and effective,” lawmakers said.

Sanitary authorization for mifepristone valid since 2000

On Monday, the United States Justice filed an appeal against Kaczmarik’s decision ordering the Food and Drug Administration (FDA) to revoke its approval for mifepristone, which has been in effect since 2000.

In the ruling, the judge argues that the FDA violated due process in approving mifepristone without considering the drug’s “adverse health effects”.

Kaczmarik, nominated by former Republican President Donald Trump (2017-2021), gave the order a week to go into effect so that the Biden administration could appeal it.

Supreme Court with conservative majority

The United States has been in a political and legal battle over abortion since the Supreme Court overturned the constitutional right to abortion by a conservative majority last June, after which dozens of Republican-run states curtailed the practice.

According to the Guttmacher Institute, 54% of abortions in the US in 2022 involved abortion pills such as mifepristone or misoprostol. (EFE)
