Plenum of the Spanish Constitutional Court (TC) finally approved the 2010 abortion law on Tuesdaywhich protects a woman’s “right” to freely terminate a pregnancy in the first 14 weeks of pregnancy.

Guarantee Court sources said the Constitutional Court rejected the conservative People’s Party (PP) appeal by a score of seven to four. v. Sexual and Reproductive Health Act and voluntary termination of pregnancy when they have passed 13 years from the date of the appeal.

Four magistrates, considered representatives of the “conservative” sector, formulated special vote against the verdict.

The result of the conclusion according to the law has been known since February. when the TC rejected the previous report and appointed the vice president, the progressive Inmaculada Montalbán, as the new speaker so she could proceed to draft another resolution that would dismiss the PP’s appeal of unconstitutionality in its entirety.

This law established free abortion as right of a woman up to 14 weeks of pregnancy and until the 22nd in case of risk to the life or health of the woman or serious fetal anomalies.

PP Appeal Considered The so-called “terminal law” of 2010 is unconstitutional. Compared to the 1985 “law of conjectures” i.e. in the case of rape, up to 22 weeks if there are risks of fetal malformations and without limitation if there is a danger to the physical and mental health of the mother.
