With well-defined rules, drivers will have greater clarity and safety when driving on public roads, which will reduce the hassle, risks of litigation and administrative proceedings, according to National Minister of Roads Adrualdo Catao.
The new regulation establishes the following definitions of vehicles:
Moped: A two- or three-wheeled vehicle with an engine capacity of up to 50 cc and a top speed limit of 50 km/h.
Bicycle: A human-powered vehicle with two wheels, not considered for the purposes of the Brazilian Traffic Regulations (CTB), similar to motorcycles, scooters and mopeds.
Self-propelled means of individual mobility: scooters, skateboards and motorized unicycles.
As parameters, the norm considers engine power, maximum production speed, mandatory equipment, registration and license plate, in addition to qualifications.
In the case of electric bicycles, the new resolution clarifies that these vehicles cannot have an accelerator. They must have an engine system that only works when the driver is pedaling, in addition to a speed indicator, bell, front and side night lights, and rear-view mirrors.
The Ministry of Transport guarantees that self-propelled personal mobility aids and electric bicycles must circulate under the same conditions as conventional bicycles. Regulation of the movement of such equipment is the responsibility of local transit authorities.

For mopeds, registration and qualifications are required, either ACC (special for 50s) or CNH Category A, which applies to all motorcycles. For vehicles that are already in circulation and do not have a make/model/version code for registration and licensing, owners have until December 31, 2023 to register them with traffic departments. The regularization deadline starts on November 1, 2023.
While a more in-depth analysis of the resolution is required when the final text of the resolution is published, it is considered to reinforce provisions already made in previous legislation. In addition, it also indicates the need for registration of small electric scooters, which are often sold as if they did not need registration, and allows vehicles that are in “suspension” due to the lack of a factory code to regulate their position.
