Parking in places intended for cars of people with disabilities is not good, to say the least. But practice shows that not every image of a wheelchair on the sidewalk makes it prohibited for ‘ordinary’ cars.

Everything is clear in a situation where we see a road sign 6.4 “Parking” in front of us, along with an information sign 8.17 “Disabled Persons”, and in the area of ​​​​its action on the asphalt flaunt the corresponding signs – marking 1.24.3. If your car is not listed in government databases as being used to transport people with health problems, you should not leave it in such a place. After all, a fine of 5,000 rubles is imposed for this – pursuant to Part 2 of Article 12.19 of the Code of Administrative Offenses “Violation of the rules for stopping or parking vehicles in places designated for stopping or parking vehicles of disabled persons .” And in large settlements such as Moscow, evacuation to a car seizure is also taking place.

And much more curious are the cases when there is a marking “disabled”, but the corresponding road sign is not visible nearby. It should be remembered here that the “letters” on the sidewalk in such situations are used solely to duplicate the designations of the sign. In particular, such a conclusion can be drawn from the rules of marking GOST R 52289-2019.

In other words, the pattern on the road surface is really just for the convenience of motorists – to make it easier for them to identify the “special” parking spot. And if the sign 6.4 “Parking” with the information sign 8.17 “Disabled” is missing, then anyone can legally park on the “handicapped” markings.

But there is one legal subtlety in this matter. It’s one thing if everything happens somewhere in a residential area or in a shopping center parking lot. In such “adjacent areas” amateur activities of the local management organization or owners of parking lots usually take place. The law requires them to allocate at least 10% of parking spaces to disabled vehicles. So they isolate them with white paint as God applies the soul. And in such cases, no one is in the business of putting up the right signs, because basically everyone is just “working out the number.”

If we talk about parking in an ordinary street of a settlement, two explanations are possible. First, parking for disabled people in a conditional zone has been canceled by the local authorities, and the traffic police are aware of this. They just forgot to erase the markers. In this case, anyone can park the car. But a different alignment is much more likely: the place is still officially considered ‘special’ – only a road sign announcing it disappeared for some reason. For example, broken or will soon be replaced by a new one. In this case, the driver could risk both a fine and an evacuation. Yes, then it will (perhaps) be possible to challenge these sanctions in court, proving the fact of the lack of the mark. But the chance of such success is by no means 100%.

Therefore, after finding “invalid” markings when parking on the street, it is better not to take risks, but to look for a parking space in another place. Even if you are sure there is no sign nearby.
