Even if you are an ardent fan of everything related to the activities of the Russian Ministry of Emergency Situations, you should not visualize your feelings by repainting your car. For this, “rights” can be taken away.
The beginning of the plot, which became the subject of consideration by the Supreme Court, was given by the events of more than a year ago, which took place in Moscow on the highway of lovers. On June 21 last year, the attention of the traffic police was caught by a silver Mitsubishi L200 pickup with a kung on the back. The interest of the police officers focused on the different color of the car.
On the hood and front bumper of the car, as well as on the sides of the roof luggage compartment, there were orange stripes, very reminiscent of those applied to the vehicles of the Ministry of Emergency Situations. Decals were found on the back and sides of the vehicle with the words “Rescuer,” “112,” a graphic depicting a stylized image of hydraulic shears used by rescue personnel and other similar environments.
A certain Fomin VV drove a striking car and it is possible that he was trying to show his approval for the activities of the Ministry of Emergency Situations in such an artistic way. It is impossible to judge this precisely, since the material of the lawsuit does not contain any explanation of the motorist on this subject. Be that as it may, the traffic police officers have issued a protocol against the citizen under part 6 of art. 12.5 of the Code of Administrative Offenses – “control of a vehicle, on the outer surfaces of which special color schemes of vehicles of operational services are illegally applied.”
Soon this case came to the table of the magistrate of section No. 291 of the Perovsky District Court. And on August 16 last year, the pickup driver was deprived of his “rights” for twelve months. Note that this is the minimum penalty under this article of the Code of Administrative Offenses. The maximum on it is a year and a half on foot. The owner of the “car” with two stripes on the hood did not agree with this decision. He hired a lawyer and appealed the decision of the justice of the peace in higher instances. Finally it came to the sun.
After studying the arguments of the indigent person and the materials of the case, Judge Kuzmichev SI decided that the stripes applied to the body of the L200, “taking into account the compositional relationship of the existing elements, are confusingly similar to the color schemes of the operational service vehicles.” Consequently, operating a car with such a paste may mislead other drivers as to the benefit of operating such a “tuned” vehicle. This increases the likelihood of an emergency situation occurring. On this basis, the Supreme Court concludes that the driver should not only be held liable for applying color schemes of operational services to the bodywork, but also for attempting to convey similar images as such.
In this regard, it was decided to uphold the original World Court judgment on the deprivation of the “rights” of the director Fomin VV. So citizens, before decorating their “swallow” with some drawing, it is worth considering whether you will experience artistic delights sideways.
