The situation is more than usual: two cars touched each other slightly, the damage is minimal. Both drivers are calm and not eager to wait for the police to arrive and report an accident. And there is no reason to contact insurers for such a small matter. After all, the guilty party will later be hit by an increase in the price of compulsory motorcycle liability insurance for the coming year, and the victim will have to wander around the offices of insurance companies and extort a penny in compensation, which, of course, will not be enough to repair damage.
Or in general, the damage is so small that it makes no practical sense to “start the barrel organ” with the European protocol and other formalities. Usually in such cases, drivers simply drive away and wish each other good luck, or the person responsible for the accident transfers an amount to the victim’s card on the spot that they both consider a worthy compensation for the damage caused.
You can of course rejoice in the presence of common sense in both participants in such a scene on the road. But as soon as the drivers shook hands and went about their business, they both became offenders from the law’s point of view. Moreover, the crime “hangs” seriously on them. This Code of Administrative Offenses is punishable by deprivation of “rights” under Article 12.27 – “leaving the scene of an accident.” The fact is that Russian law does not oblige anyone to immediately compensate damage after an accident, but it does consider registration of the incident mandatory.
In theory, if the traffic police are not aware of what happened, no one will be deprived of their “rights”. But it is at this stage that all kinds of ‘nuances’ take place. For example, a driver who has received compensation may think and think and decide that he did not receive enough money for repairs and that he has suffered moral damages. Cheaper, in general.
In order to somehow take revenge on his opponent for such a cruel injustice, he quickly returns to the scene of the accident and calls the traffic police, claiming that the second participant in the incident has fled. As a result, the deprivation of “rights” falls on his head. A “mirror” situation is also possible. The perpetrator feels sorry for the money given and decides to annoy the victim in the above way: by returning to the scene of the accident and calling the traffic police.
There is another option: when an accident occurs in the field of view of a traffic police camera, and the police themselves discover that both participants left without first formalizing their “relationship” with at least a European protocol. As a result, both may have their driver’s license confiscated. The fourth scenario is more typical of on-site accidents. When an incident is settled between neighboring car owners, but one of the witnesses to the incident (usually from the “vigilant” local residents) reports to the traffic police: an accident has occurred and the owners of such and such cars have taken it and have it is not registered. Such “arrangements” for both participants in a micro-accident also sometimes occur. And the ‘antidote’ to such excesses can only be the drawing up of a European protocol. No matter how pointless this business seems at first glance…
