The Supreme Court will check the legality of the Ministry of the Interior’s regulations on conducting driving license exams. The fact is that traffic police officers have to record the process of passing the “exercise” on camera, but after a month the recording can be deleted. As Kommersant reports, a resident of the Tver region, Anastasia Kryukova, tried to pass the “practice” at the Vyshny Volochok traffic police four times – from May 2022 to February 2023. Each time without success. After trying to prove her case at the inter-district court and losing, she appealed to the Supreme Court, where she decided to appeal against the police rules on taking exams (Decision No. 80 of the Ministry of Internal Affairs) . According to her, video footage from cameras in a traffic police car should be kept for at least a month, after which it can be destroyed – this is what happened with the recordings of Kryukova’s exams.

The regulations of the Ministry of Internal Affairs violate Article 219 of the Code of Administrative Procedures, according to which a claim can be filed in court within three months from the date of violation of civil rights. And the one-month storage period for the video, Kryukova believes, deprives her of the right to check the “objectivity and validity” of the actions of the traffic police.

The Interior Ministry responded that the document establishes a “minimum” period for storing videos, and that this can only be extended if there are “technical capabilities” for a particular traffic police unit. The reference to the Code was considered completely incorrect. The Supreme Court will have the final say in this case.
