The Ministry of Economic Development of the Russian Federation believed that the problems caused by the special military operation in Ukraine were few for Russian drivers and decided to throw another one – for those who own relatively new cars. So the department proposed to increase the terms of warranty repairs from 45 to 90 days: they say that due to a breach of the supply chains, services receive spare parts with a long delay, and this in turn is fraught with a flurry of lawsuits of citizens.
According to the current wording of art. 20 of the Act “Protection of Consumer Rights”, the warranty period for repairs shall not exceed 45 days. If – in the case of cars – the official dealer does not fit, the car owner has the right to demand a refund of the money paid for the car or replacement of the defective car with a new one. And the reason for the delays does not matter in this case.
With the logistics industry struggling, original parts (and only official dealers can use them) wait for months from abroad. It is clear that in such circumstances it is extremely difficult to meet the allotted 45 days. However, instead of finding an adequate solution to the problem that would suit both customers and businessmen, the Ministry of Economic Development suggested simply correcting the law.
The motivation of the ministry is understandable in principle: its main task is to prevent massive complaints, which escape with little bloodshed. And the problems of their consumers – as in general and all government agencies in our country – do not care about the word “absolutely”. Fortunately, such a cynical proposal did not receive much acclaim. Both the Consumers’ Association of the Russian Federation and the Automobile Service Association were against it. The latter commented that this just doesn’t make sense: those 45 days, those 90 – you still don’t have time.
The Ministry of Economic Development is currently discussing its “brilliant” initiative with Rospotrebnadzor and the Ministry of Industry and Trade. And given the way such decisions are made in our country (which are not aimed at consumer protection, but at consumer protection), it can be safely assumed that legislative changes in one form or another will come into effect.
Car owners will be left running for three months even if the outage was at the hands of the manufacturer, and dealers will be even more relaxed. Previously, when faced with delays, they apologized for a long time and offered the injured certificates for free maintenance, accessories and other “goodies”. Now you don’t even have to do that anymore. Although in this way it would be possible to solve the problem even now, because the majority of citizens are aware of the magnitude of the “catastrophic” and relate to the difficulties with understanding.
