This story started more than two years ago in Cherepovets, Vologda region. Car owner Kirill Svetlov had a great time driving his Hyundai Creta through the evening streets of his hometown. All “raspberries” were spoiled by the traffic police. They stopped the crossover, checked the documents, and started asking boring questions about tinting the car’s windows. I must say that the windows of the front doors of the “Korean”, in the best “boyish” traditions, were toned down to the state of “sealed with black insulating tape”. As usual in such cases, the police picked up the device and checked the light transmittance of the windows. We measured 6.6% at a rate of at least 70%.

Has issued a decision pursuant to part 3.1 of art. 12.5 of the Code of Administrative Offenses – “Driving a car in the presence of malfunctions or conditions under which the use of vehicles is prohibited.” The minimum fine is 500 rubles. But Mr. Svetlov decided to go on principle. Either someone told him, or he himself “dug” the following information on the Internet: Russian GOST 32565-2013 requires measuring the light transmission of automotive glass at three points, followed by calculating the average value. And traffic cops measured Crete’s hue in only one spot. The data obtained in this way were recorded in the protocol. Svetlov considered this a mistake and demanded that three measurements be taken for each window. As expected, it was rejected.

And I decided that on this basis, the fine of 500 rubles should be canceled. First, he sent a corresponding statement to the chief of the Cherepovets traffic police, then to the chief of the local police, and then “walked” through all the judicial authorities – up to the armed forces. And now the Supreme Court judge Sergey Nikiforov, having considered the case of a principled lover of “coloring with electrical tape”, came to the following conclusions. GOST 32565-2013, to which citizen Svetlov refers, says that the “three-point method” of measuring light transmission is used to check glass samples in the process of car certification.

Meanwhile, paragraph 7.8.6 of the same GOST provides for measuring the level of light transmission and according to the method described in the instructions for use for police photometers. Including, and to the device called “Tonic”, used by the traffic police inspector in the case of Svetlov. Of course, there is no such thing as “three points”. Therefore, the court found that the police officer’s refusal to comply with Svetlov’s request motivated and validated the decisions of all lower instances. So it has been proven that it is useless to call on the traffic police patrol who check the tint of your car using references to GOSTs and technical requirements. At the moment, according to Russian law, he is obliged to follow only the operating instructions for the standard photometer.
