Among the most recent “punishment” novels, which became known at the end of 2022, we should mention the amendment of the Code of Administrative Offenses of the Ministry of Internal Affairs. It concerns article 12.8 of the Code of Administrative Offenses “Driving a vehicle by a driver who is intoxicated, transferring the driving of a vehicle to a person who is intoxicated.” The Supreme Court suddenly found that it failed to regulate the issue of driving a car by a drug-taking driver. The police simply suggested supplementing the article with a ban on the driver not only using alcohol and drugs, but also drugs that impede attention and responsiveness. At the same time, the amendment says nothing about the permissible concentration of this “chemistry” in the driver’s blood. Due to this, it will soon be possible to lose “entitlements”, even if several days have passed after taking the pill – if only because of the traces of the drug in the blood.
Changes to the traffic rules, which will come into effect in early spring, will in fact lead to the appearance of fines for previously unpunished acts of a motorist. The new version of the SDA included the driver’s obligation to give way to a person traveling on it on an electric scooter or other individual means of mobility before leaving the road. This means that for violation of this requirement, the driver can be fined under Article 12.14 of the Code of Administrative Offenses of 500 rubles.
In addition, the new traffic rules banned parking and stopping cars on “safety islands” and signposts. A fine will now follow for this – as for any other wrong parking on the basis of Article 12.19 of the Code of Administrative Violations.
The fine for driving without an OSAGO policy will probably increase next year. This initiative was taken by the Deputy Executive Director of the Russian Union of Motor Insurers (RSA) Sergey Efremov. Driving without insurance is now subject to a fine of 800 rubles. Insurers demand to raise it to 5,000 rubles.
And the Duma of the city of Moscow wants to spread another punitive “capital experience” throughout the country. She proposed to the State Duma at the legislative level to allow regional authorities to impose fines on drivers on their territory for violating silence. In addition, according to the authors of the initiative, the determination of the amount of the fine should be left to the mercy of local state officials. For example, the legislators of the capital believe that the “basic” fine for driving a car with a “tuned exhaust” should be 5,000 rubles. And the more powerful the car, the “rounder” the amount of recovery of the offender should be.
