– Now many car dealers, under the pretext of “freezing activity” of car manufacturers in the Russian market, are trying to refuse car owners to repair their cars under warranty. This is illegal, – says auto expert Sergei Burgazliev.
According to him, absolutely nothing has changed in Russian legislation in the field of consumer rights in the past year. According to its provisions, the warranty obligations of the selling company to the customer can only disappear in the event of the liquidation of its legal entity. As long as the representative office of a foreign car brand in Russia and the dealer who sold the car to a citizen are not liquidated in the legally prescribed manner, a warranty repair of the car is possible and should be sought.
When a car dealer fails to fulfill its warranty obligations, the car owner must make a corresponding claim in writing and submit it to the company’s representative. If within 10 days after that the repair of the customer’s car does not start, or a warranty repair is refused, or the claim is simply ignored, you should file a complaint with Rosprebnadzor. If it doesn’t help, we’ll go to court.
– The Russian Themis, as a rule, sides with the consumer, so don’t worry or give up. You have to calmly get your way in court,” advises Sergey Pigolkin, founder of the online auction CarClick.ru.
