According to the Reuters news agency, the discovery was made by the National Labor Relations Board (NLRB), which revealed that employees were instructed not to discuss wages and working conditions with each other, and also not to complain to higher levels of management.

The NLRB found that Orlando repair shop executives illegally silenced workers in 2021 when older employees complained that new hires were being paid higher wages, Reuters reported. NLRB Administrative Judge Michael Rosas ordered Tesla to stop violating workers’ rights and ordered the service center to report the violation in the workplace and by email to employees.

The report shows that at the end of 2021, employees learned that new employees at the emergency center were receiving higher hourly wages than existing employees. Several workers complained, including a technician who contacted Tesla’s vice president and forwarded his complaint to the company’s head of human resources.

The service center managers then held a meeting where they told the 25 employees not to discuss their wages and other working conditions with each other, and not to complain to higher management. The technician who filed the complaint with senior management was fired weeks later, and in 2022 he filed a complaint against Tesla with the NLRB.

U.S. labor law condemns attempt to silence worker

Judge Rosas said Tesla’s attempt to silence its employees violated workers’ basic right under U.S. labor law to assemble and advocate for better working conditions.

Reuters reported that this is just Tesla’s latest NLRB loss. The automaker also faces lawsuits alleging widespread racial and gender discrimination at its assembly plants. In addition, a US appeals court recently upheld the NLRB decision against Tesla CEO Elon Musk.

According to the ruling, he broke the law by tweeting that employees would lose stock options if they joined a union. And Tesla is also appealing a separate NLRB ruling that says the company illegally bans factory workers from wearing union T-shirts.
