Humanity has not yet reached the level of technology worthy of science fiction, with manned space missions on every corner that need protection. But that doesn’t mean being in orbit, in International Space Station (ISS) or in Moon be synonymous with clutter and free gambling. Canada passed a law this week that allows the country to prosecute crimes committed by or against Canadians on the Moon.
Jessica Watkins today launched her first mission to the space station.
First, we will (try to) explain what territoriality and crime scene are, based on the Brazilian Criminal Code (CP). Why Brazilian and not Canadian? Because I know our code better and it’s almost identical topics in most parts of the world. Article 5 of the Criminal Code states: “For crimes committed on national territory, the law of Brazil shall apply without prejudice to conventions, treaties and international law.” The following paragraphs explain that Brazilian (public or private) and foreign ships and aircraft on national territory (including airspace) are also subject to Brazilian law. A Japanese ship in the port of Santos and an American Airlines plane flying over Brazil are subject to our laws. But nothing is said about space. And that is what Canada has corrected in its legislation.

Previously, crimes committed by or against Canadians (astronauts) in international space station were subject to the jurisdiction of justice in Canada, but were not subject to jurisdiction over crimes in orbit, the lunar surface, and travel to the moon. Such as the Canadian Space Agency brings together Artemis Projectwhich will undertake manned missions to the Moon in the coming years (both into satellite orbit and landing), the country saw the need to expand the Law.
American astronaut Ann McClain in 2019 was accused of illegally accessing the bank account of his ex-wife Summer Worden while on a business trip to the United States. ISS. What may have been the first crime committed in space was actually Worden’s false accusation against McClain. Warden was charged with fraud (on Earth).
