An Apple spokesman said the company is appealing the ban in the U.S. Court of Appeals for the Federal Circuit in Washington.
“We strongly disagree with the U.S. International Trade Commission’s decision and related exclusion, and we are taking every step possible to return Apple Watch Series 9 and Apple Watch Ultra 2 to U.S. customers as quickly as possible,” Apple said. said.
The tech giant also asked the court to lift the ban, at least until U.S. Customs and Border Protection decides whether updated versions of its watches infringe on Masimo’s patents, and while the court considers Apple’s request.
According to Apple, US customs should make their decision on January 12.
Earlier, US President Joe Biden’s administration decided to uphold the International Trade Commission’s decision to ban the import and sale of the latest Apple Watch smartwatches due to copyright infringement.
As reported, Masimo Corporation and Cercacor Laboratories, companies operating mainly in the medical field, filed a complaint with the US International Trade Commission that Apple violated their copyrights. Particularly concerned with the use of blood oxygen sensors in Apple Watch Series 9 and Apple Watch Ultra 2 smart watches, the commission decided to stop the sale of these models.
