The main character was local resident Alexey Kh, who crossed the intersection in his Skoda Octavia at the beginning of eight o’clock in the evening when the traffic light turned yellow. The driver did not take into account that this maneuver of his was recorded by a camera that automatically registered traffic violations. Apparently he was unaware of its existence.

The material was sent to the local automatic fixation center. The citizen therefore turned out to be a repeat offender. That is to say, his “exceeding” was already within the jurisdiction of Part 3 of the same article. 12.12 Code of Administrative Offenses. In case of repeated violation, this implies a fine of 5,000 rubles or deprivation of “rights” for 4 to 6 months.

Since the case concerned the possibility of depriving a citizen of his driver’s license, it was sent to the Magistrate’s Court of the Emvalsky judicial district of the Ezhvinsky district of the city of Syktyvkar, where on April 15 our hero was fined 5,000 ruble was imposed. , 2022. Note that in this case the driver was not threatened with deprivation of his driver’s license: he was “beaten” by the camera. In its ruling, the Supreme Court referred to Article 6.2 of the traffic regulations, according to which a yellow traffic light prohibits traffic. Except in cases where the car, after being turned on, cannot stop without making an emergency stop, already stops behind the stop line, hinders pedestrians or will lead to other similar consequences.

On this basis, the Supreme Court upheld the decisions of all lower authorities and left the citizen empty-handed.
