Penalties for driving a car with non-tinted windows have been the subject of discussion since the publication of the corresponding article in the Code of Administrative Offenses. The head of the State Duma Committee on Labor and Social Policy, Yaroslav Nilov, is trying to put an end to this issue.

The deputy submitted for consideration to his colleagues a draft amendment to section 3.1 of Article 12.5 of the Code of Administrative Offenses, which penalizes “driving a vehicle on which glass is installed (including vehicles covered with transparent colored films), the light transmission of which does not comply with the requirements of the technical regulation on the safety of wheeled vehicles.” It threatens the offender with a fine of 500 rubles, and if the police again catches the driver driving a tinted car, they can issue a report against him for non-compliance with the policeman’s legal requirements (remove of the hue) This is a completely different article of the Code of Administrative Offenses – 19.3, which entails an administrative detention of up to 15 days.

Now, according to GOST 33997-2016, the light transmission of the windshield and front side windows of the car should be at least 70%. Nilov proposes not to rewrite GOST, but simply to remove the fine for tinting side windows from the Code of Administrative Offenses. To do this, in the existing text of paragraph 3.1 of article 12.5 of the Code of Administrative Violations, it is sufficient to replace the word “glass” with the expression “windshield”. The explanatory memorandum to the bill states that it “is intended to create more comfortable conditions for drivers while preserving the control function of competent authorities”.

Yaroslav Nilov is listed as the sole author of the bill. This fact alone can be taken as a “big hint” that the short story won’t gain support from its fellow deputies. Most likely, the amendment will be phased out at the level of the Duma’s profile committee. It is quite possible that it will not even survive to be considered at first reading.
