An order from the Ministry of the Interior has been published, in which the technology of “limiting” the ability to drive a car to a person who did not appear on the call to the military commissar has been signed.
A citizen who, knowingly or unknowingly, did not come to the military recruiting office on call, has been for some time in a special state register of conscription evaders. It is impossible for an unsuspecting Russian to learn about this event. And now the Ministry of Internal Affairs has approved a special regulation, according to which the driver’s license of such a person will be automatically suspended – no later than one day after the date of receipt of the corresponding “signal” from the military commissars.
“Upon receipt of information formed in the unified register about citizens subject to initial military registration, or about citizens registered with the military, as well as citizens who are not registered, but are required to be registered with the military , decide on the adoption of temporary measures to ensure that they appear on the agenda of the military commissariat, in the form of a restriction on the use of a citizen’s right to drive vehicles (TC), the right to driving a vehicle in relation to an individual is restricted,” the Interior Ministry order says.
This legal mechanism will come into effect on July 11, 2023. Note that the “suspension” of WU is not at all the same as the deprivation of “rights”.
Similar methods have long been used in Russia for debtor-motorists, for whom bailiffs have opened enforcement proceedings. The FSSP employee decides to limit the effect of a person’s “rights” and informs the traffic police about this, which “freezes” the operation of the VU until the initiator of this measure gives up.
When a traffic police officer checks a driver’s documents and reveals that the citizen’s VU has been suspended by decision of a bailiff, a protocol is drawn up against the offender on the basis of art. 17.17 of the Code of Administrative Offenses – for “violation of the temporary limitation established in accordance with the legislation on enforcement procedures for the use of a special right.” It provides for punishment either in the form of hard labor of up to 50 hours, or a complete deprivation of the VU for a maximum of one year.
It is unlikely that with regard to evaders it will be possible to use an article devoted to offenses in enforcement proceedings. Consequently, such a citizen driving a car with a suspended VU meeting with a traffic cop is threatened with a protocol under another article – under section 1 12.7 of the Code of Administrative Offenses. According to it, “driving a vehicle by a driver who does not have the right to drive a vehicle” is punishable by only a fine of 5,000 to 15,000 rubles.
