Yaroslav Nilov, member of the State Duma Committee on Labor and Social Policy, has developed a bill that expands the scope of the MTPL policy. He proposed adding to the “automobile civil code” damage to cars due to potholes, snowdrifts, icicles, trees and other similar “conditions.”

The bill has not yet been submitted to the State Duma and exactly when this will happen is still unclear. However, if the initiative gains support and the changes come into effect, car owners could receive compensation through mandatory motorcycle liability insurance for car damage caused by a fall into a hole in the road, a collision with a snowdrift, an icicle falling from the roof, or even a old tree that was not cut down in time.

The explanatory memorandum to the document states that the draft law proposes changes to the law “On the Compulsory Civil Liability Insurance of Vehicle Owners” so that damage caused as a result of illegal actions – or omissions – of local government authorities responsible for the condition of roads or public utilities.

Nilov emphasized that drivers in such situations can now of course independently sue the authorities, but lawsuits could take several years and place an unnecessary burden on the legal system. Furthermore, the inability to recover damages under the insurance “reduces the level of confidence and interest in the MTPL policy.”
