An interesting story that recently happened almost a year and a half ago had to be investigated by the Supreme Court. It happened in the summer of 2022 in the Far East. Local resident Vitaly P. got on his Suzuki Lets 2 scooter around midnight on July 31 and rode along the Nakhodka-Lazo-Kavalerovo road. And everything would have been fine, but the citizen was quite drunk. And he had no documents with him. We strongly suspect that his compatriots will not see anything special in this way of acting. Because – “yes, we always do this”…
But this time the trip ended earlier than planned. At the 14th kilometer of the highway, our hero was stopped by a traffic police patrol. It immediately became clear that the “horseman” had no documents and that he smelled in a characteristic way. We decided we should test ourselves for alcohol. The device showed 0.328 milligrams of alcohol per liter of exhaled air – almost twice the legal limit. At this stage it is necessary to proceed to prepare all the required papers, which will then be sent to the court for a “judgment” of hardship.
We reiterate that Mr. P. had no identity documents on him, and that the traffic police officers were apparently not comfortable taking him and his scooter to the police station to find out ‘who is who’. As a result, the perpetrator’s identifying information was entered into the protocol simply based on his words. The astonishing gullibility of the traffic police later backfired on them.
The cunning Vitaly P. introduced himself to the traffic police as his older brother Alexander. Note that we are not talking about twins, which can easily get confused. A drunk scooter rider is five years younger than his nearest relative!
Be that as it may, the protocol was drafted and taken to court. And only then did it become clear that, according to the papers, the wrong person was being held accountable. The local police had to look for the cunning drunk. Two weeks later they caught him and received confirmation from a video recording that he was on the scooter that night and not his brother. During the trial, held on December 1, 2022, Vitalik’s creative mind led him to give a version in which, they say, he did not ride the scooter, but was a passenger. As if a nice person agreed to give him a ride… As a result, he was deprived of his “rights” for 1.5 years and fined 30,000 rubles. And the Supreme Court ultimately confirmed the correctness of this decision.
But there is another curious aspect of this story: the confidence with which the traffic police officers treated the words of the driver who was stopped for drunkenness! It’s good that the wayward P. for some reason called himself his brother. “For some reason” – because he could just as easily pretend he was his neighbor, for example. Or a friend who left town a long time ago. Or a completely fictional person. In this case, he could avoid responsibility altogether: look for his fistulas! And all because the traffic police were too lazy to do everything according to their senses and according to the law.
